Policy

Photo Delivery

Clients will receive a gallery link, from which the photos are downloadable, via text or email within 1-2 weeks (3 weeks for weddings) of the booked session date. Photos are chosen and edited by the photographer. Additional edits/filters are prohibited. However, if you are unhappy with an edited photo, please contact MNC Photo, and we will do our best to adjust the image to your preference free of charge. Though more photos may have been taken during the session, those that do not meet the photographer's standards of quality will not be included in the delivered gallery. Please note that all photos are owned by MNC Photo, and MNC Photo reserves the right to use photos of clients for advertisement, networking, branding, etc.

Payment Policy

Deposits are due at the time of booking in order to reserve the date/time agreed upon by photographer and client. Deposits are non-refundable and will be applied towards the entire payment. All other payments are agreed upon by photographer and client prior to session. Payments other than deposits are due in full up to one month after the date of the booked session. MNC Photo reserves the right to withhold images taken during the session until the client has paid the full amount. Late payments will incur incur interest of 2% for every 30 days past the invoice due date. Payments may be paid in advance in full. Payment methods accepted include cash, check, Venmo, Zelle. A $25 return check fee may be charged in the case of insufficient funds or any service fee incurred. Clients are billed by hourly rate rounded up to the nearest half hour (an hour and 45 minutes is rounded up to 2 hours). Due to the nature of the business, please note that all sales are final. The client shall reimburse or contribute to the photographer for additional costs incurred including travel ($50 for every 40 miles driven past the first 40 miles), parking, tolls, or other reasonable costs pertaining to the session. These costs will be agreed upon prior to the booked session. Damage fees may be charged in the event the photographer's gear/equipment is damaged by the client's party, which includes pets and children, during sessions.

Cancellation Policy

Last-minute cancellations do not incur any cancellation or reschedule fee, but deposits are forfeited in the case of cancellation. In the event of inclement weather, illness, or other reasons beyond control of the client or photographer, the session may be rescheduled to a new date/time agreed upon by client and photographer. If the session is rescheduled, the original deposit may rollover to rescheduled sessions. If necessary, the session type may be changed, and the final payment will be adjusted accordingly. All rescheduled sessions will require a new Client Contract.

Studio Rentals

MNC Photo photographers are equipped with portable black and white studio backdrops and lighting which require a clear space of at least 10’ x 10’ with at least one functioning electrical outlet. In the case a studio is rented for a scheduled session, it is the client’s responsibility to cover all costs of the studio reservation and to communicate with the photographer regarding the studio reservation. It is the responsibility of both the client party and MNC Photo to adhere to the reserved studio’s policies. The client’s party is responsible for any damage fees charged in the event the rented studio or photographer's gear/equipment is damaged by the client's party, which includes pets and children, during sessions.

Client Privacy

For client privacy purposes, most galleries are visible to the public but will require a password to view the photos within. Client passwords will be provided by MNC Photo to only the paying client at the time of gallery delivery. The paying client has the right to share the password with whomever at any time. Please note that all photos are owned by MNC Photo, and MNC Photo reserves the right to use photos of clients for advertisement, networking, branding, etc. If you prefer to keep your photos private (i.e. opt to exclude photos of you from public accounts owned by MNC Photo such as mncphoto.com and social media), please contact MNC Photo directly via email (MNCPhotoLLC@gmail.com).

Arbitration Clause

Any disputes or claims arising out of or relating to this Agreement, including any breach thereof, shall be resolved through binding arbitration, conducted in accordance with the rules of the American Arbitration Association. The arbitration will take place in Annapolis, Maryland, and the decision of the arbitrator(s) shall be final and binding upon the parties. Each party shall bear its own costs and attorney’s fees, except as otherwise provided by law. By agreeing to this clause, both parties waive their right to a trial by jury or to participate in a class action.

By Signing This Client Contract, You:

- Assign full copyright of these photographs to MNC Photo and its photographers.

- Agree to adhere to the payment policy stated above.

- Acknowledge that MNC Photo reserves the right to refuse delivery of photos until full payment is made by the client.

- Grant MNC Photo and its photographers permission to publish photographs taken of you during your booked session for business purposes including, but not limited to, advertising, display, networking, branding.

- Agree to pay any damage fees incurred in the case the photographer’s gear/equipment is damaged by your (client) party during paid sessions.

- Agree that any disputes related to this agreement will be resolved through binding arbitration rather than in court, and you waive the right to a jury trial or class action.

- Release MNC Photo and its photographers from all claims and liability relating to images, video, or photographs taken of you.

- Understand and agree that MNC Photo and its photographers are not responsible for misuse or discredit of photographs and images by others once the photographs and images are placed online.

- Waive your rights to review or approve photographs and images prior to digital or print release for the photographer's or company's use.

- Understand you are able to use images of yourself, taken by the MNC Photo and its photographers for your own portfolio, personal print, and social media accounts with proper credit given to MNC Photo.

- Understand that additional alteration of images in any way, including filters and re-edits not done by the photographer, other than cropping for social media purposes are prohibited.

- Understand that you are not responsible for the misuse or miscredit of the photographer's work once the photographs and images have been placed online.

Contract Duration and Renewal
This agreement remains valid for the duration of the current calendar year and is subject to annual renewal upon mutual agreement. It is understood that I am an independent business, not an employee of the school/institution. As such, I do not expect any payment beyond the amounts stated in the invoices issued for services rendered. The hourly rate specified in this agreement will remain in effect for the duration of the contract term. However, rates are subject to change after the expiration of the contract term. Any adjustments to the hourly rate will be communicated in writing and agreed upon before the renewal or commencement of a new contract term.

Due to the ongoing nature of this contract, no deposit is required. Payments will be made in accordance with the terms specified in each invoice issued for services rendered during the contract period. Payments other than deposits are due in full up to one month after the date of the booked session. MNC Photo reserves the right to withhold images taken during the session until the client has paid the full amount. Late payments will incur interest of 2% for every 30 days past the invoice due date. Payments may be paid in advance in full. Payment methods accepted include cash, check, Venmo, Zelle. A $25 return check fee may be charged in the case of insufficient funds or any service fee incurred. Clients are billed by hourly rate rounded up to the nearest hour (1.5 hours is rounded up to 2 hours). Due to the nature of the business, please note that all sales are final. The client shall reimburse or contribute to the photographer for additional costs incurred including travel ($50 for every 40 miles driven past the first 40 miles), parking, tolls, or other reasonable costs pertaining to the session. Damage fees may be charged in the event the photographer's gear/equipment is damaged by the client's party, which includes pets and children, during sessions. Please note that the hourly rate listed on this contract is solely for sports events. All other independent sessions (i.e. athlete headshots) booked with MNC Photo will require a separate contract.

Cancellation Policy

Due to the nature of sports games and events, last-minute cancellations will not incur any cancellation or rescheduling fees. In the event of inclement weather or other circumstances beyond the control of the client or photographer, the game or event may be rescheduled to a new date and time. If the session is rescheduled, the photographer will make every reasonable effort to accommodate the new date. Any additional travel or accommodation costs incurred due to the reschedule will be discussed and agreed upon in advance. If rescheduling is not possible, the client will not be charged for the canceled session.
